Unlike the 2009 and 2012 code which, combined, raised the cost of construction in Illinois by an average of $16,000 per unit, HBAI welcomes the 2015 code as it brings new options to builders and minimizes construction cost increases. For the first time since 2009, NAHB helped stop the regulatory binge at the International Code Council, while HBAI did the same with the Illinois Department of Commerce and Economic Opportunity (IDCEO). With two members now sitting on the Illinois Energy Code Advisory Council (IECAC), HBAI defeated all attempts by IDCEO to stay with the 2012 code. Later in the year and leading all the way up to late November, HBAI also checked state regulators from erasing and delaying sensible changes in the 2015 code. Even after final approval of the code by the Joint Committee on Administrative Rules (JCAR), a final ditch effort was made in late November by IDCEO officials and consultants to delay enactment of the code for six months, and reverse a new option to use the Home Energy Rating System (HERS) rating system. But all of that was turned back by builders, code officials, engineers, and architects serving on the IECAC. NAHB advised HBAI early this year to embrace the new code as long as certain changes in the code were incorporated. Don Surrena, Program Manager for the Energy Efficiency Construction Department at NAHB, drew a road map for HBAI that was successfully used by our appointees to the IECAC; Jason Huelsman and Allen Drewes. HBAI would like to thank the members of the IECAC who worked long and hard over the past several months to create a new code that is a great improvement over the previous code. Finally, did you know, whether a community enforces the Illinois Energy Conservation Code or not, Builders in Illinois are responsible for building to this statewide set of standards. Failure to do so could result in a civil action against a builder by the home owner resulting in fines and payment to upgrade to the standards set forth at the time of construction. IDCEO opposed this vehemently and refuses to include this in their state funded instruction seminars for builders and code officials.  Basement walls associated with conditioned basements shall have two options for required insulation: 1. Insulation from the top of the basement wall down to 10 feet below grade or to within six inches of the basement floor, whichever is less with an R-Value of 10/13 minimum; 2. Insulation from top of the basement down to 4 feet below grade when the basement wall R-Value is at least 15/19.  Air Leakage Rates shall be tested by a third party and verified as having an air leakage rate not exceeding five air exchanges per hour (ACH) in Climate Zones 4 and 5. The requirement for three air exchanges per hour was advocated by IDCEO. Animals  Humane Care for Animals (SB 125/PA 99-0311): States that, “No owner of a dog or cat may expose the dog or cat in a manner that places the dog or cat in a lifethreatening situation for a prolonged period of time in extreme heat or cold conditions.” Business  Illinois continues to rank near the bottom when it comes to being a business-friendly state. In 2015, however, Sen. Sue Rezin led the effort in one of the very few pro-growth, pro-jobs business reforms passed by the General Assembly during the spring session. SB 1672/PA 99-0463 will allow businesses to file and receive a permit directly from the state, instead of going through the federal government. That will speed up the application time and provide for more certainty for job creators.  Duplicative Small Business Regulations (HB 3887/PA 99-0370): Requires state agencies to examine their rules, administrative regulations, and permitting processes as they pertain to small businesses in order to identify those rules, regulations, and processes that are unreasonable, unduly burdensome, duplicative, or onerous to small businesses.  Equal Pay Act Changes (HB 3619/PA 99-0418): Provides that the Act applies to all employers (currently only employers with four or more employees). Provides that any violation of the Act will subject employers to a civil penalties. Sets different penalty structures for employees with fewer than four employees and those with four or more employees. Committing public policy violations will subject the employer to a civil penalty not to exceed $5,000.  Minimum Wage Employers Negotiations (SB 38/PA 99-0017 – Sen. Pamela Althoff): An initiative of the Illinois FOP Labor Council that amends the Minimum Wage Law by allowing a collective bargaining unit to negotiate and contractually exempt themselves from the hourly wage requirements imposed by the Act. Instead, the union can agree to an alternate shift schedule as allowed under federal law.  Residential Mortgage License Act Changes (HB 3369/PA 99-0015 – Sen. Sue Rezin): Amends the Residential Mortgage License Act to improve the efficiency and include modern best practices in the regulation of the Act.  Title Insurance Fee (HB 3910/PA 99-0104): Provides that each title insurance company fee of $3 per policy is paid by the agent or agent’s parent company. Consumers  Landlords Accumulated Interest (HB 1319/PA 99-0253): Provides that the lessor shall, within 30 days after the end of each 12-month rental period, pay to the lessee any interest that has accumulated to an amount of $5 or more, unless the lessee is in default under the terms of the lease. Hunting  Bobcat Hunting (HB 352/PA 99-0033 – Sen. Sam McCann): Amends the Wildlife Code to allow bobcat hunting in Illinois from Nov. 1 to Feb. 15.  Youth Hunting License Age (HB 3234/PA 99-0307 – Sen. Chapin Rose): Raises age cap for youth hunting licenses from 16 to 18. Law Enforcement DUI-related Safety Provisions (SB 627/PA 99-0467): Makes several recommendations based on the Traffic Safety Advisory Committee. The unemployment rate should continue falling, house prices are likely to rise by 5%, and the economy will be led almost entirely by the continuing improvement in household balance sheets, and in conjunction with increased employment and slightly faster wage growth. Government spending will be slightly higher in 2016 (but not enough to matter), capital expenditures by firms will remain weak, and exports will continue to suffer due to the strong US dollar. The most serious domestic problem is weak inflation, and it should begin to increase. Despite continuing poor global economic growth, the American economy will not weaken, but is also unlikely to strengthen much. 2016 FORECAST With this in mind, I expect full-year 2016 GDP to come in at 2.4%, slightly higher than the expected 2.2% GDP growth experienced in 2015. New housing starts should increase by about 12%, with total starts coming in at 1.25 million. Single-family starts will likely total 830,000, up from 710,000, while multifamily starts should hit 410,000, up from 400,000. New and existing home sales should rise by about 4% and end the year at 6.0 million, with mortgage purchase volume advancing by $60 billion and refinance activity falling by about $250 billion. Housing inventories should jump by about 150,000 units, to 5.5 months of inventory, up from 5.0 months now. Given the continued improving labor market, expect net new monthly job growth to average 185,000/ month, which while down from 205,000/month in 2015, is excellent given the shrinking size of the working age population. As a result, the unemployment rate should fall from 5.0% today to between 4.6% and 4.8% by year end and possibly lower, depending upon the behavior of the labor force participation rate (LFPR). If the LFPR rises, and that would be good, unemployment may end the year as high as 4.8%, but if the LFPR continues to fall, an unemployment rate of 4.6% or even 4.5% is distinctly possible. As for inflation, headline inflation will noticeably increase while core inflation (which excludes food and energy) edges up only slightly. Inflation should rise because energy and commodity prices are not likely to fall further and the dollar is unlikely to continue strengthening. As a result, the downward pressure these forces have exerted on headline inflation will cease and headline inflation, now at 0.3%, should move towards the core rate which is now at 1.3% and will probably rise to 1.7% by year end, which is still below the Fed target of 2%. As a result, the Federal Reserve will have the luxury of time to slowly raise the federal funds rate from where it is now, between 0.25% and 0.50%, to between 1.00% and 1.25% by year end, with a rate increase coming every three to four months. As a result of slightly faster GDP growth and falling unemployment in 2016, 10-year Treasuries will end the year at 2.75% and 30-year mortgage rates will probably hover around 4.5% as the yield curve flattens due to faster rising short-term rates. But slightly easing credit conditions and rising consumer spending due to improving employment numbers and wages will keep the economy and housing market on track despite mildly higher interest rates. Finally, I put the chances of a recession in 2016 at 15% to 20%. So look forward to steady economic activity in 2016 and fear not slowly ascending interest rates.
