NAHB News & Resources Midyear BOD and Leg Con - June 13-17, 2017 2017 IBS - 14% rise in floor space sold OSHA Confined Spaces Rule Dept. of Labor Overtime Regulation Waters of the United States (WOTUS) NAHB Links NAHBNow.com - NAHB Advocacy App - ValueOfNAHB.org EyeonHousing.org  HB3826 is an HBAI initiative to end double taxation of new home sales by home rule municipalities.  HB3751 would reserve who decides what assurances are made for the completion of public construction infrastructure that is eventually deeded to a local unit of government. HBAI remains opposed.  HB2816 would have mandated that all new construction contain 5% recycled materials. HBAI is opposed.  HB2771 & SB1296 mandates all employees to provide sick days for their employees. HBAI is opposed.  HB2756 expands an Act allowing stormwater management commissions in certain counties served by the Northeastern Illinois Planning Committee to all counties in Illinois. HBAI opposed  HB2615 would have placed new language in the Mechanic’s Lien Act prohibiting contractors from forcing subcontractors to waive lien rights as a condition of doing business with contractor. HBAI supports this position, but there is current language in the Act that already does this. HBAI registered opposition to HB2615 because of another provision in the bill allowing oral agreements on lien waivers. The Illinois Land Title Association opposed the measure, as well, and the bill was held from consideration on the House Civil Law Committee.  HB366 would have increased penalties for violating the Employee Classification Act. The sponsor withheld the bill from consideration in the house Labor Committee at the request of HBAI and the Illinois Dept. of Labor.  SB09, the omnibus taxation bill that is part of the Grand Bargain in the Illinois Senate, still sits on 3rd Reading there. HBAI will be ramping up opposition to the Service Tax portion of the 500 page bill, as it places a sales tax on home repair services. 4 Alex Martindale, Regional Field Representative of NAHB gave everyone a better understanding of the value of being a NAHB member and the benefits that are available. What makes this decline particularly baffling is that in late 2016, after seeing prices languish for two years, the Organization of Oil Producing Countries (OPEC) announced that it, along with non-OPEC members such as Russia, would collectively reduce production by 1.8 million bbl/day, or 2% of global supply, starting January 1st. Many observers thought that removing that much supply would stop inventory growth and put upward pressure on prices. After the decision to curtail pumping was announced, oil prices, as expected, quickly jumped from about $43/bbl to close to $55/bbl. Recently, however, oil prices have again started falling. The question is why, and is this decline more likely to be temporary or permanent? High Storage Levels, Low Oil Prices increasing production. The third factor is that in the months leading up to January 1, 2017, when the above-mentioned production cuts were to commence, most OPEC nations sharply raised production levels and exports to maximize short-term revenues. And, after weeks of transatlantic travel, this oil is now finally reaching US shores. There are four main reasons why oil prices are again declining. Firstly, the decision to cut global production set off a flurry of buying by hedge funds, which pushed up prices. However, the rise in prices also encouraged American shale producers to ramp up drilling and production. To wit, the number of oil rigs in operation has more than doubled in the past 12 months. Since OPEC announced that production cuts were coming, US production has increased by almost 500,000 bbl/ day. Moreover, the number of wells that are drilled but uncompleted (DUCs) has risen from 1,250 to 1,750. As oil prices recover, DUCs, which can be quickly completed, are likely to flood the market with yet more supply. Second, several OPEC nations, including Iran, Libya, and Nigeria, were, for any number of reasons, not asked to cut production and have instead all increased production dramatically. Further complicating matters is that many of the nations that have been called upon to make cuts do not have a great history of compliance. In addition, Canada and other non-OPEC nations that are in no way involved with OPEC are also 13 The final factor is the shape of the curve of futures prices, which is closely related to inventory levels. Inventory levels continue to rise and are now at a record 540 million barrels. With inventories so large, near-term prices for oil are lower than long-term prices, a relatively infrequent situation known as a contango. When the contango is sufficiently large, such that storage costs are less than the long-term price of oil minus the short-term price, which is currently the case, investors and speculators buy oil and store it. In the process, the near-term price of oil is driven lower still. To break this cycle, OPEC will have to convince markets that inventories will soon decline and thereby raise near-term prices. The best way to do this would be to promise to extend the current production cuts that are set to expire on June 30th and perhaps promise additional production cuts. The only problem is that as prices rise in response those actions, American shale drillers will drill more wells and the cycle will continue. The agencies have warned that if Illinois doesn’t resolve its budget issues by May 31 – the end of the state legislative session – it may be punished with more downgrades. It’s quite possible the agencies could downgrade Illinois bonds to junk status. Ted Dabrowski Vice President of Policy Illinois Policy Institute A junk rating of Illinois’ bonds isn’t just some wonky financial designation that only affects politicians. It has real consequences for the people of Illinois, from the most vulnerable to the wealthiest. Illinois’ political class is to blame for the state’s financial collapse. Lawmakers have been unwilling to enact the spending reforms to stop the bleed and the economic reforms to grow the state’s tax base. Falling to ‘junk’ Illinois, which already has the lowest credit rating of any state, will become the nation’s first junk-rated state if the rating agencies follow through on their downgrade warnings. The only remotely similar companion in this disgrace will be Puerto Rico, the junk-rated American territory that’s suffering a deep crisis of its own. A junk rating would be another blow to Illinois’ already low reputation, further discouraging investment, job creators and the in-migration of new residents. It would also hurt Illinois financially and push up borrowing costs, taking even more funds away from core government programs and social service providers. The state’s fall to junk credit status has been a long time coming. For decades, Illinois politicians have ignored important issues, passed fake reforms and papered over Illinois’ structural problems with tax hikes. Lawmakers haven’t passed a real balanced budget since 2001. A lack of real pension reform has driven Illinois’ pension debt to $130 billion, up nearly $100 billion from a decade ago. And inadequate property tax reform and tax hikes have shrunk Illinois’ tax base, both in people and dollars. As a result, Illinois has been downgraded 19 times by the three major rating agencies since 2009 alone, according to the Commission on Government Forecasting and Accountability. The city of Chicago is already junk-rated. Chicago Public Schools is even deeper in junk territory. And Illinois’ public universities are now facing additional credit downgrades as well. Northeastern Illinois University was recently downgraded further into junk status by the ratings agencies as part of a major review of all universities by Standard & Poor’s. Without major reforms, such as moving state workers to 401(k)-style plans and comprehensive property tax reform, things will only get worse for both Illinoisans and the economy. Illinois needs a real plan Many politicians and pundits and those in the media think that Illinois needs a deal, any deal, to end the current crisis. But Illinois’ past is littered with bad deals enacted in the midst of a crisis. They’re what got Illinois into its current crisis. Former Gov. Jim Edgar’s 1996 pension ramp was a disaster that Illinoisans continue to pay for today. Former Gov. Rod Blagojevich’s $10 billion pension bond deliberately avoided addressing pension reform and simply left Illinoisans with more debt. And former Gov. Pat Quinn’s copycat deals borrowed another $7 billion. Then Quinn’s temporary income tax hike allowed politicians to raise spending, leaving Illinois on a budgetary cliff when that tax hike expired. Every one of those deals had something in common – they all avoided fixing Illinois’ structural spending problems. The Senate’s proposed “grand bargain” does the same. It will only perpetuate Illinois’ dysfunction, something that Illinoisans simply cannot afford. A real plan – and a real balanced budget – must solve those structural problems.
