Friends, family, and neighbors encouraging me to get back involved in politics and start a campaign to return as Ward 7 Councillor. Neal Anderson had announced he would not seek reelection. Of course, the first thing I did was talk it over with my family. The question was, did I have to offer what Ward 7 needs today? As I began to think more seriously about a campaign, I spoke to friends and neighbors in the Ward. Knocking on doors will tell you a lot about what the residents are feeling, and four generations of Simonellis in Ward 7 leaves me with deep relationships to call upon. I was eager to find out how the issues on the minds of voters had changed in the past 10 years. THE PAST Having served as Ward 7 Councillor from 1998 to 2008, my track record is well documented. As the Ward 7 Councillor, I focused on affordable housing, public safety, and green space, and did so with innovative solutions. Affordable Housing The fruits of our labor on affordable housing can be found throughout Ward 7. In the areas of Cross Street, Grape Street and Bryant Street, we created affordable home ownership opportunities by developing underutilized city parcels, and making the single-family homes available through preferences to Malden residents. This took coordinating activities across multiple governmental agencies, and filing state legislation needed to support the land disposition. The end result was worth it. Across from Lincoln Commons, and working with Housing Families, we developed a unique affordable housing solution that integrated life skills training and provided a permanent home for Housing Families. We did so only after we held multiple neighborhood meetings to gain valuable feedback from residents that only strengthened the end result. As a Ward Councillor, I understood that affordable housing solutions needed to solve multiple challenges, and worked tirelessly on real solutions that met those challenges. Public Safety My over 20 years of experience in law enforcement has taught me that public safety starts with community involvement. During my tenure, we focused on programs that fostered a strong and trusting relationship with law enforcement, while educating our residents on the perils of drugs and violence. We created programs that engaged the Ward 7 community through things like after school programs, embraced community policy, and in the process drove down crime to all-time lows. Recreation and Green Space There was a time when Ward 7 was the forgotten Ward when it came to green space. Those days are gone. The creation of Lincoln Commons, a spectacular passive recreation space on the site of the old Lincoln Junior High, is a textbook example of collaboration and innovation. The neighborhood supported the creation of passive recreation space, but the funding was a challenge. By accessing a variety of funding sources, including Community Development Grant money, we were able to deliver the neighborhood a park they could be proud of. We followed that up by securing grant funding from private sources like Pepsi and AT&T to deliver the first ever skate park in Malden. We renovated Miller Park with a new basketball court, planted new trees, expanded green space, and added a tot lot. Together we led the way in the creation of unique recreation space with thoughtful funding plans. THE PRESENT As I’ve begun to knock doors, attend neighborhood events, connect with old friends, it’s clear that some of the challenges of old have resurfaced, along with some new ones. Residents of Ward 7 want to see a concerted effort to reduce crime. I agree. Lifelong residents of Ward 7 want to see us address the skyrocketing cost of housing. There is a strong need for greater investment in our roads and sidewalks. Our lower income residents and our communities of color have been disproportionately impacted by the pandemic. Our seniors, for whom COVID had a devastating impact leaving many feeling isolated and lonely, are in need of extra attention through focused programs and support. The dream was short, as most are, and had a surreal feel to it, as most do. Think Twilight Zone meets The Outer Limits. So, we’re sitting on a park bench somewhere, anywhere. In the dream Jack looks 25 at times and 125 other times. He’s got a faraway look in his eyes also. He’s smoking a cigarette as usual, but this one never ends, it just stays lit. And he is letting me know that in the great beyond he’s “finally found some happiness.” He is no longer hungry all the time he tells me. His feet no longer cause him unbearable pain. His biggest thrill so far was Day 1 when he visited “Hillbilly Heaven” and had his long-anticipated one-on-one with the Hillbilly Bard himself, “King Hiram Williams” aka Hank Williams Sr. Having elevated Hank to iconic stature at an early age (1957), Jack was pleasantly surprised to find out, after only a short chat, that Hank was down to earth and charming without a hint of ego or aggrandizement. Jack told me he prepared for this recitation his whole life. Jack talked. Jack prattled. Jack rambled on, starstruck – how Hank inspired him; how, through the years, Hank led Jack hand in hand from honky-tonk to honky-tonk, Hank on one side, the savior on the other. Hank politely interjected, looked Jack in his steely blues, took him by the hand and simply said, “one bourbon, one scotch, one beer,” name your pleasure, my friend, it’s on the house. Jack was overjoyed to find out that nobody has a drinking problem in Heaven, and you can drink till dawn and not make a fool of yourself all night. He says he spends a lot of time hanging around a roadside honky-tonk listening to Meade Lux Lewis, “Papa” Jimmy Yancy and Pete Johnson trade licks on a house piano – too self-conscious about his playing to join in. I told him, as I told him many times when he was alive, that he may not have been the best piano player that ever lived but he was certainly one of the best entertainers that ever walked planet earth. And he should never be ashamed that he stole every one of Jerry Lee’s moves! Flat out I told him, you could shred the piano better than anybody else in Boston (well, maybe not David Maxwell but he got the point). He always got a chuckle out of that, and still does. He told me that Clara Ward remembered him from that time in front of Boston Technical High School after a performance with the Ward Gospel Singers. She said, with a hearty laugh, “How could I not remember signing that program for the only 6' 4" 140-pound white boy in the audience.” Liberace chuckled when they first met. The Abney Brothers of New Mexico had never set foot in Massachusetts, let alone the Eastern part of the United States, before they touched down at Logan Airport. They were born, raised and lived all of their just under six decades in that Southwest state. But circled #1 on their list of destinations for the pair after their arrival in Boston was a midsized, urban community close by: Malden, Mass. Specifically, Matt and Robert Abney intended on visiting Malden High School, a place they felt they knew, though never having been there. Marjorie (Holbrook) Bailey played on the Malden High girls’ basketball team beginning in 1925 and through her graduation year of 1927. The 1920s were very strong ones for the Golden Tornados teams on both the girls’ and boys’ sides, with a number of championships won in a variety of sports. Girls’ sports were still in their formative years, both at Malden High and also statewide, though the Golden Tornados girls’ basketball teams in the late 1920s were recognized as some of the best in the state. Robert and Matt Abney brought several photos of their grandparents’ teams from the mid-1920s to Malden High one recent afternoon and donated them in their family name to the school. Much to their delight, there were already in place several trophy cases in the MHS hallway across from the cafeterias, near the main entrance of the school, with a robust collection of vintage sports team photos, including others from the 1920s, on prominent display. “We just wanted to see the place where it all began, and to help preserve some of this great Malden High history,” Robert Abney said. The visit to Greater Boston had another, more poignant mission. The Abneys’ mother, Beth Holbrook Bailey Abney, has passed away in January at 78, and after stopping at Malden High, they had intended on driving to nearby Revere Beach. As an ode to her East Coast roots – having been born in Fitchburg and lived for several years in this area, where her parents grew up – the brothers intended to inter some of her ashes at the beach, which is historically recognized as the very first public beach in America. The Abneys’ dad, Larry, 75, had passed away just four months earlier in September 2020. He was a Vietnam veteran and retired clinical social worker, where he worked for many years at the New Mexico Behavioral Institute, where he had worked with his wife, Beth. As had their grandparents before them, the Abney brothers grew up as sports-minded guys. Both Abneys, tall like their parents and grandparents, were involved in basketball as trainers and coaches. Matt Abney was the owner of the New Mexico Flash basketball program for a number of years. It has magnified the challenges we face in Ward 7. The encouraging news is that the federal government has stepped up in a big way with federal programs to address the impacts, in particular with the passing of the American Rescue Plan. This almost $2 trillion federal bill is focused on assisting those impacted the most by the pandemic. More important than anything for the next Ward 7 Councillor is a proven track record of advocacy and innovative thinking to gain access to this funding to help the vibrant, diverse community of Ward 7 recover from the toll the pandemic has taken and to utilize this once in a lifetime funding to solve problems in Ward 7. Sincerely, Ligia Noriega-Murphy, Superintendent Malden Public Schools ~ LEGAL NOTICE ~ COMMONWEALTH OF MASSACHUSETTS THE TRIAL COURT PROBATE AND FAMILY COURT SUPREME JUDICIAL COURT RECENT CASE A BIG BOOST TO UPHOLDING WELL SETTLED TRUST LAW A July 23, 2021 decision by the Massachusetts Supreme Judicial Court (SJC) upheld well settled Trust law and now provides the elder bar with more certainty in drafting irrevocable trusts in the context of Medicaid planning. MassHealth’s legal department could not persuade the SJC that a special or limited power of appointment contained in the applicant’s irrevocable trust caused the trust principal to be countable thereby resulting in ineligibility for MassHealth benefits for the applicant. The SJC cited the Restatement (Third) of Property: Wills and Other Donative Transfers, Section 17.2 (2011) and many Superior Court and Appellate Court cases as grounds for its decision against MassHealth. The benefits of this SJC case for the elderly in Massachusetts are profound. MassHealth has over the last 10 years or so been attacking almost any provision contained in an irrevocable trust in order to deny MassHealth benefits, even though so many of its legal arguments have been in complete contradiction with well settled case law and statutory law. Itsarguments seemed to be more based upon its own ideology as to desired outcomes as opposed to them being based upon the actual law. In the case at hand, the applicant and her husband were the Settlors of an irrevocable trust. There was a provision in the trust granting the applicant, during her lifetime, a limited power of appointment to appoint all or any portion of the trust principal to a nonprofit or charitable organization over which she has no controlling interest. MassHealth argued that the applicant could appoint the trust principal to a nonprofit nursing home in order to pay for her nursing home care, and as a result, the entire principal of the trust was countable thereby making the applicant ineligible for MassHealth benefits. The SJC went on to state that since the applicant possessed a special or limited power of appointment, she could not appoint to an otherwise permissible beneficiary in any way that could benefit herself. As a matter of trust common law, statutory law and case law, a special or limited power of appointment, by definition, can never be utilized by the Donee of the power to benefit himself or herself in any way. After MassHealth appealed the Superior Court decision, the SJC took the case directly from the Superior Court thereby bypassing the Appeals Court altogether. The SJC also made it clear that a use and occupancy provision contained in an irrevocable trust likewise did not make the trust principal countable. The decision also made it clear that a trust instrument must be read as a whole in order to determine the Settlor’s intent when he or she executed the document. Trust provisions should not be read in isolation. Rather, they should be read in the context of reading the Trust instrument as a whole. Only then can you determine the Settlor’s intent when creating the Trust.This was an impactful opinion rendered by the SJC based upon excellent legal reasoning.Thank you to the Mass Chapter of the National Academy of Elder Law Attorneys and the Mass Bar Association. He was flattered that I was inspired by him, and that I so deftly incorporated some of his flamboyance into my act. But he was confused by Jack’s reaction when he got home that night from the concert and ripped up all his pictures. Jack told him, “It’s complicated.” “Mother Mahalia” (Jackson) blushed upon meeting Jack for the first time. She smiled and told him how much she enjoyed his performances, especially during his Shipwreck Lounge days. But she did chastise him for one night at the Shipwreck and a profanity-laced rendition of “In the Upper Room” barking out insanely about “the celestial starship” taking him to the “upper room” where all earthly and otherwise delights awaited him. She did apologize, though, for never sending him a letter of thanks for the portrait he had drawn of her which hung in her foyer for many years. She reminds Jack each day after a heartfelt discussion that “without a song, each day would be a century.” Best part of the day, he tells me. As Peter Falk’s iconic TV character “Columbo” would say, “Just one more thing, sir” – I write this little ode to John Lincoln Coughlin with love of course. I respected and admired the man. As for his faith, it was unshakeable; on the road to find out since forever. I can personally attest to that. Everything above has some basis in fact. Clara Ward did sign for him after a performance, and as much as I tried to persuade Jack to gift the signature to me, he held onto it even in death. Jack’s portrait of Mahalia did hang in her foyer. Jack was reading an interview in 1965 with her from Look Magazine and noticed it displayed in the background. True story. Jack fell in love with Hank Sr. aka Luke the Drifter Christmas morning 1957 and never looked back. The Liberace photos actually were destroyed. And as Jack also once explained to me, it was indeed “complicated.” In Jack’s later years, I was privileged to have spent an inordinate amount of time with him as his manager/babysitter/confidant. Don’t get me wrong, there were many cringeworthy moments, but for the most part I considered myself lucky to have been part of and present to so many brilliant performances. I sincerely hope that Jack’s lifelong quest for the truth and his lifelong quest for peace of mind (which he never achieved above ground) came to fruition. Retired Fire Captain Hubert Otis Matheny, Jr. 66, died July 20, 2021, after a battle with cancer, his wife and sister by his side. Burt was born July 3, 1955 in Malden to Hubert Otis Matheny, Jr. and Diane Kathleen Slade (Matheny) (Bedell). He grew up in Malden, graduated from Malden High School in 1974. After graduation he joined the USAF as a firefighter from 1975 to 1979. In 1976 he married Aliceann Wright; they were happily married for 45 years. After discharge from the Air force, he moved to NH and became a firefighter at Durham/UNH where he rose up in the ranks to shift captain until 2008. He worked parttime at Toys R Us until 2016. Burt volunteered at the Seacoast Science Center in Rye, NH for 25 years. He leaves behind His brother Gary Matheny (Lilian) and mother of Gary's children Gunilla Matheny; sisters Margo Kneeland (Kevin); Gloria Matheny-Eren; sister-in-law Cynthia Haggerty (Brian). He was predeceased by his mother and husband Paul Bedell; father Hubert and stepmother Lela Matheny; grandparents Edward Slade and Beatrice Peterson who were very important figures in Burt's life. I’m 62-years-old and have been seeing a nice man for about a year. We’ve been talking about getting married, but I want to make sure I understand all the possible consequences beforehand. Divorced Widow Dear Divorced, Getting remarried later in life can actually bring about a host of financial and legal issues that are much more complicated than they are for younger couples just starting out. Here are some common problem areas you need to think about, and some tips that can help you solve them. Estate Plan: Getting remarried can have a big effect on your estate plan. Even if your will leaves everything to your kids, in most states spouses are automatically entitled to a share of your estate – usually one-third to one-half. If you don’t want to leave a third or more of your assets to your new partner, get a prenuptial agreement where you both agree not to take anything from the other’s estate. If you do want to leave something to your spouse and ensure your heirs receive their inheritance, a trust is the best option. Medical and Long-Term Care: As a married couple, you and your husband will be responsible for each other’s medical and long-term care bills. This is one of the main reasons many older couples choose to live together instead of marrying. Staying unmarried lets you and your partner qualify individually for public benefits, such as Medicaid (which pays nursing home costs), without draining the other one’s resources. But, if you remarry and can afford it, consider getting a long-term care insurance policy to protect your assets. See AALTCI.org to help you find one. Home: If you’re planning on living in your house or vice versa, you also need to think about what will happen to the house when the owner dies. If, for example, you both decide to live in your home, but you want your kids to inherit the place after you die, putting the house in both names is not an option. But, you may also not want your heirs to evict him once you die. One solution is for you to give your surviving husband a life estate, which gives him the right to live in your property during his lifetime. Then once he dies, the house will pass to your heirs. Social Security: Getting remarried can also affect your Social Security benefits if you’re divorced, widowed or are receiving SSI. For instance, getting remarried makes you ineligible for divorced spouse’s benefits. And getting remarried before age 60 (50 if you’re disabled) will cause widows and widowers to lose their right to survivor’s benefits from their former spouse. For more information, see SSA.gov. Pension Benefits: Be aware that if you’re receiving a survivor’s annuity from a public employees pension, getting remarried may cause you to lose it. In addition, widows and widowers of military personnel killed in the line of duty may lose their benefits if they remarry before age 57, and survivors of federal civil servants that receive a pension will forfeit it if they remarry before 55. Alimony: If you are receiving alimony from an ex-spouse, it will almost certainly end if you remarry and might even be cut off if you live together. College Aid: If you have any children in college receiving financial aid, getting married and adding a new spouse’s income to the family could affect what he or she gets.
