he may have been a bit of
a novice on Wednesday in
examining the excavation site
and viewing the metal devices
that had been removed and
replaced. But U.S. House Assistant
Speaker Katherine Clark
(D-Fifth District) is certainly not
new at delivering for her Malden
constituents. On Wednesday,
the local Congresswoman
toured a worksite in the upper
West End of Malden where she
announced her success in securing
a request for a $3.36 million
grant from the federal Community
Projects Funding (CPF) program,
which would go toward
Malden’s lead service pipe replacement
project.

200 families.

Rosi’s passion for tackling issues
with housing and homelessness
began when she
worked as an HFI Housing Advocate,

her to identify many systemic
inefficiencies and inconsistencies
tied to subsidized housing.
This experience prompted her

being appointed CEO in
2019, she served as HFI’s Director
of Homelessness Prevention
and Advocacy.
Rosi is a graduate of Suffolk
Law School, and in her spare
time she has worked on pro
bono Domestic Violence and
Special Education projects.
Rosi is a board member of Metro
North Housing Corp and
also a member of the Real Estate/Affordable
Housing Section
of the Boston Bar Association.
Each
year, the MCSW invites
all state legislators to nominate
one individual from their
district to receive recognition
at the Commonwealth Heroines
event. The recognition is
intended to highlight the contributions
of women who make
a difference in communities
across the Commonwealth.
These women are not normally
recognized by the media but
perform acts of kindness every
day to help those around them.
The MCSW is an independent
state agency that was legislatively
created in 1998 to advance
women of the Commonwealth
to full equality in all areas
of life and to promote their
rights and opportunities. The
Commission provides a voice
for Massachusetts women and
is comprised of 19 members
who are appointed by the Governor,
Senate President, Speaker
of the House of Representatives
and the Caucus of Women

T
he early teenage years are
challenging enough for
those making the switch from
kids to burgeoning young adulthood.
Taking the first steps as a
high school student can present
its own set of challenges and
tribulations.
One of several programs under
way this summer directed
by the Malden Public Schools
(MPS) Guidance Department is
the popular Malden Adventures
& Academic Program (MAAP).
The program is geared to giving
incoming ninth-graders a bird’seye
view on what to expect and
how to prepare for life as a high
school student at Malden High
School. A group of 30 former
middle-schoolers are participating
in this summer’s program,
which is based at Malden High
and under the direction of MHS
ninth-grader guidance counselors
Amy Yu and Allison MacDonald.
The MAAP Program is
a two-week transition program
which began Monday and continues
through July 22, Monday
through Friday, 8:00 a.m. to noon.
According to MPS Director
of Guidance Erin Craven, the
MAAP Program has been very
successful in helping incoming
ninth-graders get acclimated
to Malden High and
have a better understanding of

is a big change and an important

eighth-graders, who are coming
to the high school for the

Malden delegation secures $600K
for city and local organizations

tate Senator Jason Lewis
and State Representatives
Paul Donato, Steven Ultrino and
Kate Lipper-Garabedian have
secured $600,000 in funding
earmarks for the City of Malden
as part of the state budget process.
The funding was included
in the Fiscal Year 2022 (FY22)
state budget that was enacted
by the House and Senate on
July 9 and is now before Governor
Charlie Baker for his review.
The budget represents a compromise
spending plan that reconciles
the differences between
earlier versions of the budget
approved by the House in April
and the Senate in May.
This budget maintains fiscal
responsibility, does not cut services
and makes targeted investments
to address emerging
needs, safeguard the health
and wellness of the most vulnerable
populations and ensure
residents will benefit equitably
as the state recovers from the
impacts of the COVID-19 pandemic.

t was refreshing to see the Malden Senior Center open after
nearly a year and a half of being closed.
On the day it opened I was greeted by employee named
Debbie, who greeted me with a warm smile and said: “Welcome
stranger!”
There are times in life that we do not appreciate many things
until we no longer have them.
As seniors, we should all be grateful for the opportunities and
many programs at the Malden Senior Center.

Kevin Duffy’s World

is name is Kevin. He is Malden’s
best friend. He is also
the Strategy and Business Development
Officer for the City
of Malden. Hence, Malden’s best
friend. On any given day he can
be found strutting through Malden
Square waving to friends,
small talking Malden Square
regulars and shaking hands with
grateful merchants, all the while
not breaking stride or a sweat.
He is that cool – not as cool as
his dad, though. Brendan Duffy
was a legend. He had mad cool.
He would also be extremely
proud of his son Kevin were he
alive today.
Because this column is all
about deep, probing questions
on everything from life, to love,
to liberty, the questions that follow,
which Kevin so kindly answered,

Michelle Bucci Luong announces candidacy
for Ward 7 City Councillor
Every Person Counts!
With great pause and a
thoughtful approach, I am formally
announcing my candidacy
for the Ward 7 City Council
seat. As a long-time Ward
7 resident and current School
Committee representative, I
have seen many changes over
the years, some good and
some have been challenging.
What has stayed continuous
is the proud community that
surrounds us and a need for
a voice that will continue to
move Ward 7 and our diverse
city forward.
A little bit about me.
I am a wife and mom of two
amazing girls. Yes, I still live on
Daniels Street next door to my
childhood home. I attended
the Daniels School and graduated
from Malden High School,
and went on to Salem State College,
where I graduated with my
Michelle Bucci Luong
Bachelor of Arts and Science Degree.
Giving
back to my community
through the years has always
been my way to pay it forward.
Over 20 years ago, I walked with
the friends of Ferryway Green
not only to preserve historic
Ferryway Green but to save
the Lincoln School from being
taken away from a community
that needed it most. My desire
to provide advocacy in my community
led me to be named
Vice Chairman of the Ward 7
Democratic City Committee as
well as President of the Zonta
Club of Malden. I have had
the honor this past year to lead
this club through the most trying
of times and watch it flourish
in our community with each
member playing an important
role and giving back to those
in need.
As a small business owner, I
worked diligently to provide
over 1500 masks for the Malden
Neighbors Helping Neighbors
organization that they then
sewed and donated throughout
the Malden community.
As Ward 7 School Committee
Representative, as promised,
I fought for the rights of
every child to have the same
opportunities regardless of
their race, economic status,
disability, housing location or
gifted mind. I have spoken to
families, encouraging them
to be their own voice for their
child and walked beside them.
I fought for transparency with
the now annual special education
audit. This annual report
will track the services that are
delivered to families by giving
each parent a voice in the
process. I reinstated the anti-bullying
task force, which is
working to complete a review
of our bully prevention plan,
providing uniform policies
across the district, and creating
a channel of dialogue between
the administration and
the community.
I would like to continue to
give back to the neighborhood
I love as your next Ward 7 City

is too many. Yet, in Malden and
across our district, thousands
of families receive drinking water
through lead pipes and service
lines.”
She summed up her sentiment
about securing the funding
request and, hopefully, helping
buttress the city’s ambitious
project quite simply. “Malden
deserves this,” Assistant Speaker
Clark said.
The CPF is part of a nationwide
push, backed by a $45 billion
budgetary expenditure pushed
by President Joe Biden to eliminate
the nation’s remaining lead
pipes, calling them “a clear and
present danger” to local communities
in an address to Congress
in April.
There are as many as 10 million
lead service lines in the
United States, with an estimated
220,000 in Massachusetts, according
to state and federal environmental
officials.
Wednesday’s site tour was
led by Mayor Gary Christenson
at 54 Corey Rd., which is located
on the West End highlands,
and also on hand were Malden

health hazard for low-income

Malden has been identified as
the community with the highest
percentage of lead service lines
in the Greater Boston Area. The
$3.36 million funding request
would accelerate the replacement
of lead service lines delivering
drinking water to Malden
residents.

the school, all to help acclimate
them with the school and to get
an early look at how they will
fare as ninth-graders.
As part of the program this
week, the students got a treat
when they got a visit from Malden
Mayor Gary Christenson,
who stopped by to greet them
and then participate in a question
& answer session. In his session,
the Mayor described how
a typical day would go for him,
starting with a 5 a.m. wakeup,
a walk to work which entails
his now trademark litter pickup,
followed by a jam-packed
day of meetings (now mostly
in-person, after many months
of Zoom-style remote ones). Often,
as he did on Tuesday, Mayor
Christenson includes visits
to various places around the
community, now that the protocols
regarding the COVID-19
pandemic have shifted to more
open gatherings and events.
The Mayor told the incoming
ninth-graders they are embarking
on “an eventful journey
with plenty of great experiences
ahead.”
He encouraged them to “become
involved, try as many new
things as you can.”
“Of all the recently-graduated
Malden High seniors I have spoken
to, they all had the same response:
‘I was happy to have
been involved in so many different
things... and I wish I did
more,’” the Mayor said.
He also encouraged them to
give it their best effort, using a
personal note. “I have always
found that you get as much as
you put in,” he said. “I have tried
to live by that motto and it has

Roberto Di Marco announces
candidacy for City Councillor-at-Large
M
alden Attorney Roberto
Di Marco recently announced
his intention to seek
a position on the Malden City
Council, filing the necessary
paperwork for the creation of
a finance committee. Di Marco
cited his love of his hometown
and his desire to serve
the public as reasons for entering
the race. “Malden welcomed
my father when he immigrated
to this country the same way it
welcomed my mother’s grandparents
when they immigrated
here. Although they arrived
60 years apart, they each found
Malden to be a city that greeted
new residents with open
arms, bringing each new family
into the fabric of the community.
When my time came, I
chose to make Malden my own
family’s home for those same
reasons,” said Di Marco. “I have
made my home here and I am
raising my family here. I have
attended church here all my
life and built a business here in
Malden. For all that Malden has
given me, I feel it is my duty to
give my time and talents to the
city I love.” Di Marco attended
Malden’s former Emerson Elementary
School and Beebe Junior
High School. He graduated
from Malden Catholic High
School and earned his bachelor’s
degree from Brown University.
After graduating from college,
Di Marco taught special
needs students at the Landmark
School in Beverly and obtained
graduate school credits toward
a master’s degree in special education.
Di Marco earned his J.D.
degree from Northeastern University
School of Law. “Malden
has experienced tremendous
prosperity in the past 30 years,
earning a unique place among
the most desirable cities in Massachusetts,
but that prosperity
has also created many challenges
and left many of our citizens
behind, an injustice that needs
to be addressed,” said Di Marco.
“Additionally, political rifts have
developed that concern me. My
goal is to unite our city leaders
to focus on what will continue
to make Malden a great place
to live and work for families
of all ethnicities and cultures.
Consensus is key to ensuring
that Malden continues to grow
strong and prosperous.” In 2003,
Di Marco opened his own law
office in Malden. His firm, Foster,
Walker & Di Marco, has provided
legal representation to scores
of Malden residents over its 18year
history. In those 18 years, Di
Marco has been the Chair of the
Malden Conservation Commission
and a founding member of
the Community Preservation
Commission. Currently, Di Marco
is a member of the Board of
Trustees for Malden Catholic.
As an attorney and community
member, he has personally
represented individuals before
various boards and departments
in the city of Malden.
He has brought new developments
and businesses to Malden
while maintaining a focus
on the benefits to the community.
Di Marco and his wife, Dr.
Maria Teresa Davila, have been
married for 24 years and have
four children. “MT” was born
and raised in Puerto Rico, did
her graduate master’s studies
at Boston University, followed
by a PhD at Boston College. She
is a professor of Christian Ethics
at Merrimack College and a
public speaker and writer on issues
of poverty, class and race.
Their children have all attended
Malden’s Forestdale Elementary
and Middle School, participated
in local youth sports programs
and community events.
Di Marco’s mother, Mary-Anne
(Puleo) Di Marco, was a public
school teacher at Malden’s former
Lincoln Junior High and at
Malden High School. She currently
works as the director of
the Foreign Students Program
at Malden Catholic. Di Marco’s
family has owned and operated
several businesses in Malden
and the surrounding area over
the past few decades, including
his grandparents’ restaurant,
The Highland Café, a Malden
institution.

for the MHS-Malden Rec. Baseball Camp

he Malden Public Schools and
the Malden Recreation Department
launched a joint venture
this summer, cohosting several
sport-specific instructional
camps. Malden residents of all
ages were welcome to attend,
and the registration was free of
charge to all. The most well-attended
of all the camps this
week was the Malden High-Malden
Rec. Baseball Camp held at
Rotondi Field in Malden, Monday
through Friday.

municipal elections in Malden
history.
When two sitting Malden
Councillors-at-Large – twotime
ticket-topper Debbie DeMaria
and two-term Councillor
Stephen Winslow – announced
they would not seek reelection
to their posts, it guaranteed a
closely watched race would
emerge. Previously, another City
Council seat had opened when
Ward 6 Councillor David Camell
announced he would not run for
a third term this year. Winslow
quickly made his announcement
that while he would not
seek two more years as Councillor-at-Large,
he would be a candidate
for the now open Ward 6
City Council seat. And a fourth
City Council seat became open
when City Council President and
longtime Ward 7 Councillor Neal
Anderson announced he would
not seek reelection.

With the Councillor-at-Large
race now wide open with two
open seats, a number of candidates
entered the fray. At latest
glance, there are now seven
candidates listed as having taken
out nomination papers, with
three having already secured
enough signatures or local registered
voters on their papers
to ensure a place on this fall’s
ballot. The deadline is Tuesday,
July 27 to submit the required
signatures.

election, falling short in that race
as Christenson was reelected to

The open Ward 7 Councillor
seat with Anderson’s announcement
drew a quick move
by Ward 7 School Committee
Member Michelle Luong to announce
a run for that post. Luong
was the only announced
candidate for about two months
before another former Councillor,
Chris Simonelli, the popular
former Ward 7 Councillor, took
out nomination papers. Simonelli,
who served in the early
2000s after defeating Anderson
for the position, was once
considered a potential mayoral
candidate in the late 2000s.
Simonelli left his City Council
seat for a municipal job in 2007
and last ran for office in 2011:
an unsuccessful bid for Councillor-at-Large.
With
several other potential
contested races in the City
Council and School Committee,
this fall’s municipal election is really
shaping up as one to watch.

of 150 lines per year. The
city has consistently exceeded
this requirement, with a primary
goal being to expedite the elimination
of all lead service lines in
the shortest possible amount of
time. As of 2021, there are 2,076
lead lines remaining.
Mayor Christenson said the
$3.36 million funding grant
would be crucial to speeding
up the timetable of this major
municipal infrastructure project,
which has been made a top priority
by the Mayor and the Malden
City Council.
The city owns the line from
the water main to the curb, and
the property owner owns the
rest of the line that travels under
their private property. The
cost of replacing the private side
has traditionally fallen on property
owners. A lack of owner-initiated
lead service line replacements
in the past few years suggests
that residents lack the income
or capital needed to pay
for the replacement.
During the visit, Rep. Clark
was able to speak with City Engineer
Yem Lip, Senior Engineer,
Glen Calla, Superintendent of
the Water Department John
DeSantis and contractors from
Moriarty & Sons who were on
site to explain the lead replacement
process. The Mayor’s Office
has been working closely
with Clark’s office to submit the
funding request along with support
from the City Council and
other organizations.
Assistant Speaker Clark said
more work is required to see
that the House Appropriations
bill receives support from the
U.S. Senate in its budget determinations.

The Hidden Dangers
of Sleep Apnea
Dear Savvy Senior,
How can you know when someone has sleep apnea? My
husband has become such a terrible snorer that he wakes himself
up at night, and he keeps me up too.

Dear Teri,
If your husband is a loud snorer who wakes himself up
during sleep, he probably needs to be tested for sleep apnea,
a dangerous disorder that affects more than 22 million
Americans, but often goes undiagnosed.
Sleep apnea is a disorder that causes a person to stop
breathing during sleep, hundreds of times during the night,
for 10 seconds or more at a time. Left untreated, it can cause
extreme daytime sleepiness, as well as a host of serious health
conditions like high blood pressure, heart attack, stroke,
diabetes and dementia. In fact, it’s estimated that every year,
around 38,000 Americans die in their sleep from a heart attack
or stroke because of sleep apnea.
But the good news is that sleep apnea is very treatable and
most insurance companies, including Medicare, cover it.
Who Has It?
There are three types of sleep apnea: obstructive, central
and mixed. Of the three, obstructive sleep apnea (or OSA) is
by far the most common and occurs when the throat muscles
relax during sleep, blocking the airway.
While anyone can have it, sleep apnea is most common in
people who are overweight, male, middle-aged and older. For
women, the risk increases after menopause.
The symptoms include loud snoring (however not everyone
who snores has apnea), long pauses of breathing, gasping or
choking during sleep and daytime drowsiness. But because
most of these symptoms happen during sleep, most people
don’t recognize them. It’s usually the person they’re sleeping
with who notices it.
Diagnosing Sleep Apnea
To help you get a handle on your husband’s problem, the
American Sleep Apnea Association has several diagnostic tests
he can take at SleepApnea.org/treat – click on “Test Yourself.”
If the screening indicates that he may have sleep apnea,
make an appointment with his doctor or a sleep specialist
who will probably recommend an overnight diagnostic sleep
test called polysomnography, which can take place at a sleep
center lab (see SleepEducation.com), or at home using a
portable device.
Treatment Options
Your husband is at greater risk for sleep apnea if he’s
overweight, smokes, and/or consumes excessive amounts
of alcohol. Excess weight, especially around the neck, puts
pressure on the airway, which can cause it to collapse. Smoking
can increase the amount of inflammation and fluid retention in
the upper airway. And alcohol and sleeping pills can relax the
muscles in the back of his throat, interfering with breathing.
Addressing these issues, if necessary, is usually the first line
of treatment.
If that doesn’t do the trick, mild cases of sleep apnea may
respond to oral devices that fit into the mouth like a removable
mouth guard or retainer. These devices work by positioning
the lower jaw slightly forward to keep the airway open during
sleep.
Another noninvasive treatment option to consider is the
new FDA approved eXciteOSA device (eXciteOSA.com). This
treats sleep apnea and snoring by improving tongue muscle
function by delivering electrical stimulation to the tongue
through a mouthpiece that’s worn for just 20 minutes during
the day.
If none of these options work, the most effective and
commonly prescribed treatment for OBA is a continuous
positive airway pressure (CPAP) device. This involves sleeping
with a snorkel-like mask that’s hooked up to a machine that
gently blows air up the nose to keep the passages open.

recent Massachusetts Superior
Court Judge held
against MassHealth with respect
to the countability of assets
housed in an irrevocable
Trust. It is well settled law that
for purposes of determining
eligibility for MassHealth benefits,
countable assets include
any portion of the Trust principal
that could under any circumstances
be paid to or for
the benefit of the applicant.
Such circumstances need not
have occurred, or even be imminent,
in order for the principal
to be treated as countable
assets; it is enough that the
amount could be made available
to the applicant under
any circumstances. This was set
forth in the Heyn case, a Massachusetts
Appeals Court case
decided in 2016.
In this Superior Court case,
the applicant had retained a
limited or special power of appointment
in the Trust that she
created that she could have exercised
during her lifetime “to
appoint the remaining principal
and any undistributed income
of the Trust among the
members of the class consisting
of her issue of all generations or
charitable organizations other
than governmental entities,
but no such power or payment
shall be used to discharge a legal
obligation of the applicant”.
In a simple sense, appoint is another
word for distribute and an
example of issue would be children
or grandchildren.
MassHealth argued that if the
applicant appointed Trust principal
to family members, those
family members could then in
turn return the Trust principal
to the applicant to be used for
her benefit. The Superior Court
once again cited the Heyn case
which stated that “Medicaid
does not consider assets held
by other family members who
might, by reason of love but
without legal obligation, voluntarily
contribute monies toward
the grantor’s support”.
The grantor of the Trust is also
referred to as the Settlor or Donor,
and in this case, was the
applicant for MassHealth benefits
as well.
The court also stated that
“the limited power of appointment
is exercisable only in favor
of permissible appointees, and
any attempt to exercise a limited
power of appointment in favor
of an impermissible appointee
(i.e. to use principal for the
personal benefit of the grantor),
is therefore invalid.
An appointment to a permissible
appointee is ineffective to
the extent that it was:
1. Conditioned on the appointee
conferring a benefit on
the impermissible appointee
2. Subject to a charge in favor
of an impermissible appointee
3. Upon a trust for the benefit
of an impermissible appointee
4. In consideration of a benefit
conferred upon or promised
to an impermissible appointee
5. Primarily for the benefit of
the appointee’s creditor, if that
creditor is an impermissible appointee,
or
6. Motivated in any other way
to be for the benefit of an impermissible
appointee.
The above six items are set
forth in the Restatement (Third)
of Property and the Superior
Court judge held that MassHealth
cannot argue that Trust
principal could ever be distributed
to a permissible appointee
in order to benefit the applicant
and held that none of
the Trust principal was countable.
The applicant then qualified
for MassHealth benefits. In
the case at hand, no principal
could under any circumstances
be appointed to the applicant.
The applicant clearly was not
a permissible appointee. If she
was, her retained right would
have been deemed a general
power of appointment thereby
providing her a right to receive
Trust principal.

extravaganza. Kids as well as
grownups were amused and entertained

Molis and the Mayor getting in
on the action. Gina and her crew
were with the Saint Rocco Feast
a few years back. Amazing company,

The turn of the century saw an influx
of Italians and Jews into the
Malden mix, eventually helping
to create Malden, the All-American
city it was/is today. Police
Captain Glen Cronin explained
to me at the Juneteenth Celebration
how he did some research
and discovered that 50
languages were spoken at Malden
High School in 2021. Amazing
to think a mere 40 or so years
ago, during my high school days,
only one language was spoken
(and that one not even very well
by many of us – insert smiley

came over as a shoemaker but
switched careers to become
a truck driver after he learned
how to drive, distributing food
and vegetables by horse and
buggy first before purchasing a
truck and starting his own business.
On the side, he drove a cab.
A very religious man, Harry studied
Torah at the North Russell
Street Shul, where he also sang
in the choir. He had vocal chops!
I remember many weekends
at the house on Charles Street
being entertained by Grandpa,
who felt he was the second
coming of Yossele Rosenblatt. In
1928 Meyer Wolf (a baker from
Brookline) and Jacob Goldberg
(a real estate agent from Boston)
attested that Harry was
of “good moral character” and
signed the affidavit for his naturalization
papers. The rest is history,
as they say. The immigrant
story, isn’t it a wonderful thing?
