Our HBA is one of the strongest HBAs in Illinois and have one of the highest retention rates

Kurt Prenzler has seen the ups and downs in the industry since a young child and understands the
needs that are needed for improvement and applauds those in the industry for their heart and
dedication. Viewing nearby states it is obvious that simplifying building regulations and zoning is
needed.
As County Treasurer from 2010-2016 he exposed unethical tax sales, reduced budget by 30%
(saving $2 million), ran ethical tax sales, exposed investment scheme and increased deposits in
local banks (from $30 to $90 million).
As Chairman for the last 10 months he has accomplished reforming purchasing process, saved millions on courthouse
renovation with millions more to be saved in the jail renovation, changed animal control to a “no kill” model, reduced
tax spending by >$1million/year, new direction to Metro East Sanitary District to name a few..
Edwardsville Mayor Hal Patton is running for Illinois State Senate in the 56th District. As a
business man owning his own dental office he is aware of the struggles of being a business owner
in IL. His leadership experience and accomplishments as business owner and Mayor will help him
get Illinois growing again.
Illinois has suffered from some of the worst legislative-driven bureaucracy in the nation and it is
time to solve the financial problems and stop wasting residents’ tax dollars. He will bring ideas to
lower health care costs and wants to see the growth of investment and business expansion in
Edwardsville spread to the rest of the state.
To keep residents from leaving Illinois we need to create businesses that have good-paying jobs, invest in infrastructure
that fosters growth and good education from K-12 that also includes vocational programs in junior colleges.
Jason’s campaign manager Brent Ellis (pictured on the right) shared that
Jason’s focus is to provide the people of Southern Illinois access to quality
jobs, lower taxes and safer neighborhoods in the wake of the opioid
epidemic and related crime wave that threatens the health, safety, and
welfare of communities across the state.
Jason Plummer is
running for Illinois
State Senate in the
54th District.
He supports lowering and capping out-of-control property taxes, will fight
to reduce the regulations that destroy quality jobs throughout Southern Illinois, will be a staunch
advocate for giving law enforcement the tools they need to win the war against crime, and
promises to represent the strong family values of Southern Illinois.

from Bill Ward, HBAI Executive Vice President & Director of Governmental Affairs
HR527, a resolution for the House Revenue Committee to
investigate property assessments in Illinois. This, I believe,
is in response to the weeklong series of articles published
by the Chicago Tribune which details the inequities and
poor management of the Cook County Assessor’s
office. That being said, point #6 of the resolution:
“analyze preferential assessments including farm
evaluation, open space, and developer relief;.”
“Developer Relief” is the official title of what we in this
association refer to as “The Vacant Lot Act.” The Vacant
Lot Act allows developers to keep the assessment of a
completed lot at the prior assessment until such time that
the property is transferred to the next owner.
We have safeguarded the Vacant Lot Act and the Model
Home Act since the recession of the 1980s. We as an
association must now swarm like bees to secure this
benefit for years to come by meeting with the sponsor and
with others on the House Revenue Committee over the
coming months to emphasize its importance of this benefit
to our industry.
All of the legislators involved with this committee are
above I-80 and HBAI will be calling on the assistance of
HBAGC, Northern, SSHBA, and Rockford to make our
visits count over the next few weeks.
“What is the “developer’s” exemption? Section 10-30 of
the Illinois Property Tax Code1 gives a preferential
property assessment for acreage that is in transition from
vacant land to a residential, commercial, or industrial use.
The purpose of the preferential assessment is to encourage
real estate development by providing a tax incentive that
protects a developer from paying increased taxes until a
return on the investment can be made. As a result, the
preferential assessment is often called the “developer’s
exemption” or “developer’s rate”. The preferential
assessment is available in all counties except Cook
County.
For anyone not familiar with the “Developer Exemption”
the information above was published by the Illinois
Department of Revenue. It is an extremely important
exemption for builders and developers. As stated by the
IDR, “ The purpose of the preferential assessment is to
encourage real estate development by providing a tax
incentive that protects a developer from paying increased
taxes until a return on the investment can be made.”
 Since there are no residents until the vacant lots are
occupied by a home there is little or no cost to the taxing
bodies when the developer makes the investment to
improve the subdivision with infrastructure, i.e. no burden
to schools, fire departments, park districts or other
governmental bodies.
 Each lot is reassessed at market when a home is build
an occupied and will start to utilize public services. The
cost of an increased assessment for what is a vacant lot
producing no income can increase the carry cost of a
subdivision by 3% to 4% per year.
With the very weak market for homes in the current
market it can take up to 4 years for a public builder and
more than 10 years four smaller custom builders to sell the
lots subdivision. This impact can be dramatic on any
proforma for new lot development.
This increase in taxes which are not needed for vacant
lots which utilize no public services is an unnecessary
tax burden that will raise the cost of housing to the
consumer, make new homes less affordable, slow sales
even further and in the end in many instances cause
new development of quality lots to be economically
unfeasible.

Almost daily, we hear that robots, machine
learning, and automation will destroy jobs -- and
not just a few, but tens of millions of them, and
soon! Some experts predict that 47% of all US
jobs are at high risk of disappearing over the next
few decades due to computerization; others predict
even more dire outcomes. Doomsayers suggest
that “this time is different,” and that the
technological apocalypse to come will be so
profound that we are on the precipice of an
employment crisis. I doubt it -- just think about
electricity and how disruptive it was, or how
farming was transformed by mechanization and
massive consolidation, yet employment growth in
both cases hardly skipped a beat.

fact, adjusted for labor force size, 57% of the jobs
that workers performed in 1960 no longer exist!
As for the second reason, because Americans now
consume substantially more services than in the
past, and because the goods they consume are less
easily automated, technological disruption moves
much more slowly than before. That is, massages
and boat cruises are services that are very labor
intensive and cannot be automated, and even
goods such as artisanal cheese and free-range eggs
lend themselves to less automation than the
manufacturing of American cheese slices and
amusement park rides. As a
result, robots and artificial
intelligence can replace a lot
less economic activity than we
might think. And this is likely
to continue. Just consider for a
moment the likelihood of a
parent leaving their young
child in the care of a robot.
This pessimism would be at least plausible if there
were a shred of evidence to support it! While the
US economy has numerous problems, job creation
is not one of them. Nonfarm employment and has
risen for 87 months in a row, and job growth has
been twice its sustainable level for years, driving
the unemployment rate down to its best level in
decades. Moreover, labor productivity growth,
which should be skyrocketing because of all these
robots and automation, is, in a word, abysmal.
In fact, going back to 1850, job creation and
destruction, as measured by job losses in slowgrowing
occupations and job growth in fastgrowing
ones, is at its lowest level on record!
There are two main reasons for this: first, the past
was much more convulsive than we think. The

better off. Otherwise, our ever-tightening labor
market and aging population will cause wages to
rise and growth to decline. In short, we need
technology to destroy more jobs more quickly.

As NAHBNow has reported, the Occupational Safety and Health
Administration (OSHA) has decreased the permissible levels of exposure
to crystalline silica for construction.
NAHB has told policy makers from the start that this wide-reaching rule
will be difficult to meet and enforce. But it’s the law of the land, pending
any change from NAHB’s legal challenge still outstanding.
Dan Johnson, CSP, managing partner of SFI Compliance Inc., a national
safety consulting firm and member of the NAHB Safety Committee, told
us what home builders need to know to comply with the new rule and
avoid fines.
It looks like you’re going to be busy.
It is a far-reaching standard, and a challenge to comply with in many
ways. Home builders definitely need to be aware of this. Even if you use
subcontractors, builders may still have oversight responsibilities for the
jobsite. OSHA, under its multi-employer citation policy, calls that the
“controlling employer.” As the CE, the home builder has general oversight
responsibility over the jobsite, including the power to correct safety and
health violations itself or require others to correct them. This creates
potential liability for the builder if crystalline silica exposures above the
permissible levels are present.
What materials or actions create silica dust?
Silica naturally exists in things like soil, stone and granite. It becomes an
exposure issue for workers when dust is created from the many work
processes of home building including drilling, chipping, sawing and
sanding materials like tile, concrete, brick, stone, fiber cement siding and
others. In short, it’s really about the dust.
How can silica dust be mitigated to meet this rule?
For your subcontractors, or you if it’s your team doing the work, it’s a
matter of keeping silica dust out of the air so that it is out of the
breathable zone of the worker. The two main ways to eliminate the dust
is to vacuum as the dust is being created or spray water to keep it from
going into the air. Both can be accomplished with add-on attachments to
power tools or with the use of specific tool models. You can use a
jackhammer with a water delivery system, for example. Or you can use a
shroud and dust collection system on a handheld drill.
What is your advice to home builders?
I’d reach out to every single subcontractor I have and alert them in an
email or other written communication and ask for written confirmation that
they are aware of and complying with the silica requirements. And I’d
save that documentation.
Remember, if it happens on your job, you have potential liability. If I walk
up to my jobsite and see a dust cloud, it’s my responsibility in supervising
the worksite and the overall build to stop that contractor and notify them
they need to comply before continuing their work. Not all dust clouds are
necessarily silica — some alternative products are on the market like
drywall mud that contain no silica. But you need to check the product’s
safety data sheet (SDS) to be sure.
How prepared are home builders in the industry for this rule?
I think this is still in a really early stage in terms of implementation by
builders and contractors. It’s very important to go to OSHA’s website and
to use the materials from NAHB to take the necessary actions to get into
compliance. The 30-day “good faith” compliance period will end soon, so
builders really need to get a firm hold on this.
I also think there will be some surprises, especially among smaller
builders. A guy doing 10 homes a year may not even know about this
rule. I think this will catch those home builders off guard.
How have you seen builders and contractors going about meeting
this rule so far? Any examples?
We worked with a cabinet installer, who actually did a lot of the legwork
and research herself and did a great job. She knew she drilled and
installed material into concrete, therefore creating silica dust, and went to
the Table 1 instructions from OSHA’s silica rule, and opted to buy a drill
with dust collection system and knew she had to use a specific filter
vacuum. So that’s the ideal scenario: A contractor identifies that an
aspect of the work they do causes silica dust, and they seek out a means
of keeping it out of the air.
What about respirators?
That’s actually a pretty tricky aspect of all this. If you cannot keep all dust
out of the air in the first place, you can use respirators to help keep the
airborne silica out of your workers’ lungs and monitor the air content of
your worksite for silica yourself. Under this method, your workers are also
required to have medical evaluations performed on them if they wear
respirators for 30 days or more in a year.
But keep in mind, if an employer chooses to use respirators, those
respirators have to be used correctly. That includes being clean shaven
to have a proper seal on the worker’s face, and ensuring the worker is
trained, fit tested and medically cleared to use the respirator. Since it is
more difficult to breathe with the device, heart and other conditions can
make them dangerous to use. And again, you’re taking the risk that the
worker will consistently and properly use the device, when they have a lot
of other things taking their focus on the worksite.
That said, it’s important to note too that for durations of exposure lasting
more than four hours per day, and depending on indoor or outdoor
conditions for the worker, respirator use may be a requirement of Table 1
— even if you are using dust collection or water delivery. You really have
to do your homework.
How to do you go about helping your clients with silica
compliance?
We share the information I’ve mentioned here and the documentation
from OSHA, and we help the client identify all the areas where silica dust
can be created in their work process so that they know what to watch out
for. We also have developed a checklist that home builders and
remodelers can share with their subcontractors to help make them aware
of the silica requirements and get their commitment that they are in
compliance.

OSHA’s website has the details of the enhanced requirements that took
effect Sept. 23. NAHB has a Silica in Construction Toolkit that includes
helpful guidance and a set of tools and products sold by manufacturers to
aid in compliance. These products and claims have not been verified by
NAHB, but serve as a helpful start for home builders and contractors as a
reference.
